New Jersey DOH - Opining on the ‘Dangerousness’ Requirement for Inpatient Competency Restoration

This brief training program presents a decision-making rubric to be used in opining on the dangerousness requirement for inpatient competency restoration. An overview of the ways in which various states deal with this similar requirement is presented and a checklist for thinking through this requirement and arriving at an opinion regarding dangerousness is discussed.
Upon completion of this program you will be able to:
Describe relevant criteria that can be used to arrive at an opinion regarding a defendant’s need for inpatient competency restoration services
Describe the criteria that various states use to determine whether a defendant requires inpatient competency restoration services
Describe a checklist of considerations for making a determination regarding inpatient competency restoration
Describe the language that should be used in New Jersey competency evaluation reports to address this issue
