New Jersey DOH - Assessment of Malingering in Pretrial Criminal Evaluations

This training program reviews the process of assessing for malingering in the context of pre-trial criminal evaluations. The focus is on decision-making through all aspects of the evaluation process, including whether to administer any of the tests and techniques currently available and if so, selecting the most appropriate tests for any given case. Among the tests reviewed in this workshop are measures such as the Test of Memory Malingering (TOMM), Validity Indicator Profile (VIP), MMPI (all versions), Structured Interview of Reported Symptoms (SIRS), and the Miller Forensic Assessment of Symptoms Test (M-FAST). In addition, this presentation will address issues related to the interpretation of tests administered and the integration of multiple data sources into the ultimate decisions about the validity of an individual’s clinical presentation for assessing malingering of cognitive impairment and psychiatric disturbance. Finally, the use and misuse of malingering tests with linguistic and culturally diverse defendants is discussed.

  • Describe the impact of diversity (including but not limited to language, culture, and intellectual functioning) on the interpretation of test data

  • Describe ethical standards regarding assessment practice when administering, interpreting and communicating test results

Barry Rosenfeld, PhD, ABPP

Barry Rosenfeld is a Professor of Psychology and Adjunct Professor of Law at Fordham University. He is currently the President of the American Psychology-Law Society and past president of the International Association of Forensic Mental Health Services. Dr. Rosenfeld has published more than 200 peer-reviewed journal articles and book chapters addressing a wide range of topics in psychology and law, including malingering, violence risk assessment, and cross-cultural issues in forensic assessment. He is also board certified in forensic psychology and conducts evaluations in both civil and criminal forensic settings, including individuals in diverse cultural settings both within and outside of the U.S.
