This on-demand professional training program on Ethical Issues in Sex Offense-Specific Assessment and Treatment is presented by Randy Otto, PhD, ABPP, and Marc A. Martinez, PhD, ABPP.

This program is intended for psychologists who treat or evaluate persons with a history of sexual offending. Using a case vignette approach, this program identifies common ethical dilemmas encountered in this area of practice and provides strategies for navigating these situations. After brief reviews of ethical decision-making and risk management strategies, matters including issues of roles and boundaries, privacy and confidentiality, assessment procedures, and one’s obligation to make efforts to maintain the security of test materials will be discussed.

Learning Objectives

Upon completion of this training, participants will be able to:

  • 1 Describe two risk management strategies attendees can employ when treating or assessing persons with a history of sexual offending
  • 2 Describe key sources of authority that impose obligations on mental health professionals when assessing and treating persons with a history of sexual offending
  • 3 Describe three ways that the primary issue of “role” shapes mental health professionals’ obligations when evaluating or treating persons with a history of sexual offending
  • 4 Describe the difference between privacy, confidentiality, and privilege, and identify the resulting obligations mental health professionals have when assessing or treating persons with a history of sexual offending
  • 5 Describe how mental health professionals should consider matters of individual differences when treating or evaluating persons with a history of sexual offending, and describe how obligations to consider individual differences can be met

    Beginner:

    Clinicians with some experience in forensic or sex offense-specific work, looking to deepen their understanding of complex ethical dilemmas, sources of authority, and nuanced issues of roles, boundaries, and confidentiality.

    Experienced professionals seeking to refine their expertise in managing high-level ethical challenges, integrating advanced risk management strategies, and addressing individual differences in complex cases.

Randy Otto, PhD, ABPP, Associate Professor in the NSU Department of Clinical and School Psychology

Randy Otto, Ph.D., ABPP is an Associate Professor in the NSU Department of Clinical and School Psychology. Previously, he was a faculty member in the Department of Mental Health Law & Policy at the University of South Florida, where he served for 33 years. Dr. Otto was awarded doctoral and master’s degrees in clinical psychology from Florida State University, and a bachelor’s degree in psychology from the University of Rochester. Dr. Otto’s research and writing focus on forensic psychological assessment. He has developed two psychological tests that are used in forensic assessment settings, and he has authored and edited books on forensic psychological evaluation, expert testimony and report writing, ethics in forensic psychology practice, assessment of trial competence, violence risk assessment and Florida mental health law. Dr. Otto has served as president of the American Psychology-Law Society, the American Board of Forensic Psychology, and the Board of Trustees of the American Board of Professional Psychology. He is a fellow of the American Psychological Association (Division 41) and has received awards for his professional contributions from the American Academy of Forensic Psychology, the American Psychology-Law Society, the Society for Personality Assessment, the New York State Psychological Association, the University of Nebraska, and the University of California, San Francisco. He currently serves as Executive Director of the American Board of Forensic Psychology. Dr. Otto shares that his daughter is continually amazed that some are actually willing to pay to hear him speak, when she regularly volunteers to pay to have him shut up. When not at work or with his wife and daughter, Dr. Otto is likely to be found at a poker table or on a motorcycle.

Dr. Martinez is a psychologist licensed in Indiana (Health Service Provider in Psychology), Ohio, and New York. He also has authority to Practice Interjurisdictional Telepsychology (APIT) and Temporary Authorization to Practice (TAP) under PSYPACT. In 2011, Dr. Martinez became board certified by the American Board of Professional Psychology (ABPP) in Forensic Psychology. Since 2012, Dr. Martinez has maintained a private practice that specializes in forensic psychological evaluations of juveniles and adults involved in civil and criminal legal matters. Most commonly, Dr. Martinez provides evaluations related to competency to stand trial, criminal responsibility/insanity defense, sexual recidivism risk (including civil commitment of individuals who commit sexual offenses), and violence recidivism risk. In addition to his private practice, Dr. Martinez has been an ethics and risk management consultant to mental health professionals for The Trust’s professional liability insurance program since 2020. He has published and presented on various topics related to the practice of forensic psychology, such as sexual and violence risk assessment and ethical practice. He has also served in several national leadership positions such as President and Treasurer of the American Board of Forensic Psychology, Chair and Vice Chair of ABPP’s Ethics Committee, and Chair of the American Psychology Association’s Committee on Professional Practice and Standards.
